Terms of Service
These Terms govern your use of the services provided by ServiceAlly ("ServiceAlly," "we," "us," or "our"). By signing up for or using our services, you agree to these Terms. Plain-English summaries are provided for clarity; the full terms control.
1. What we provide
ServiceAlly sets up and operates a marketing and customer-communication system for your business — which may include a website, missed-call text-back, website chat, a shared inbox, local listings and search work, and review requests — delivered on a white-labeled platform. We provide the setup and ongoing operation; you remain responsible for the work you sell and deliver to your own customers.
2. Pricing & billing
- Your price. $1,000/mo, which includes building your website and both systems in full. A limited Founding Five rate of $500/mo applies to the first five clients for their first twelve consecutive months of service, after which the standard $1,000/mo rate applies. The Founding Five rate is offered in exchange for permission to publish your performance figures and two introductions within your trade; if you decline either, the standard rate applies and nothing further is owed. The rate shown to you at signup is your rate. No setup, build or activation fee applies.
- Everything included. Standard texting, messaging and follow-ups are included in your flat monthly price — subject to the Fair Use policy in Section 4. We do not charge per-message or per-minute fees for normal use.
- When billing starts. You place a card on file at signup and are not charged until you review and approve the completed build, targeted for day 10 from your intake call. Your first charge is the rate shown at signup: $1,000 a month, $500 a month under the Founding Five rate, or the annual prepay. See Section 9 for the full commitment. If you have not approved the build within 30 days of your intake call, we will discuss with you before any charge is made.

3. Month-to-month & cancellation
Plain English: No contracts. Cancel anytime. You keep your website, your domain, your phone number and your reviews, whatever happens — the automated features (missed-call text-back, website chat, the shared inbox and review requests) stop when your subscription ends.
Service is month-to-month with no long-term contract. You may cancel at any time; cancellation stops future billing. A monthly fee already charged for the current month is not refunded, but you will not be billed again after you cancel. If you prepaid for a year, we refund the whole months you have not used.
Upon cancellation you retain your website, domain, phone number and reviews, and may request an export of your customer/contact data. The automated and connected features of the system — including missed-call text-back, website chat, review requests and the shared inbox — are delivered through our operated platform and will stop functioning when your subscription ends. In other words: the website stays yours; the lead-catching system that runs on top of it is part of the ongoing service.
4. Fair use of messaging
Your flat monthly price includes a generous allotment of texts and messages that comfortably covers normal use for a typical service business (as a guide, on the order of ~1,500 text segments per month). This is intended to make your bill predictable — no surprise per-message charges for ordinary operation.
Plain English: Use it normally and you'll never see an extra charge. If your volume grows far beyond a typical business (into the thousands of messages a month), we'll simply talk with you about moving to a higher plan that fits — never a surprise fee.
If usage substantially and consistently exceeds the included allotment, we will contact you to move you to an appropriate plan. We do not offer "unlimited" messaging; sustained excessive use, use that violates carrier rules, or use in a way that incurs abnormal third-party costs is not permitted under the flat rate. We reserve the right to adjust an account that consistently exceeds fair-use levels after notifying you.
5. Your responsibilities
- Provide accurate business information and any content, logos, or access we need to build and run your system.
- Use the messaging features in compliance with applicable laws and carrier rules (including obtaining proper consent from your own customers before messaging them, and honoring opt-outs).
- Not use the services for unlawful, deceptive, or prohibited content (including the carrier-restricted "SHAFT" categories: sex, hate, alcohol, firearms, tobacco), or to send spam.
6. Messaging consent & opt-out
The only messages we send on your behalf are review requests to your own customers after a job you have done for them, replies to people who contacted you first, and the missed-call text-back. We do not run marketing campaigns to your customer list — see Section 10. Recipients can reply STOP to opt out and HELP for help. Our handling of personal information is described in our Privacy Policy.
7. Our response commitment
Plain English: Every missed call is texted back within 60 seconds during the hours you set. Texts and messages are handled in the shared inbox. A real voice answering the phone is not part of this service. If you want it later, it is quoted separately.

8. Build timeline
We aim to have your website and system live within 10 business days of your intake call, provided you supply the content and account access we need on time. Your existing website, if you have one, stays live and unchanged until the new one is ready to launch.
9. Card on file, no setup fee

10. Your past customers
Reactivating the customers you already have is not part of the monthly service. Marketing texts and emails to a customer list need documented permission from each person on it, and the liability for getting that wrong falls on whoever presses send. We are not willing to carry that for you, and we are not willing to expose you to it either.
If you want seasonal campaigns, we will write them for you as a separate piece of work. You send them from your own account. You confirm in writing that every recipient has given you permission to be contacted that way, and we will tell you plainly if we do not think your permissions hold up.
We never buy, rent or scrape contact lists, and we will not send to one.
11. Ownership
Your website, your domain, your phone number and your reviews are yours. Not licensed to you, not hosted on a platform you cannot leave — yours. If you cancel, you keep all of it, we hand over the files and the logins, and we help you move them. There is no exit process and nothing to argue about.
12. No guarantee of specific results
We work hard to help you capture and convert more leads, but we do not guarantee a specific number of jobs, revenue, or outcomes. Results depend on factors outside our control, including your existing lead flow, your market, and how you handle the leads we surface.
13. Limitation of liability
To the fullest extent permitted by law, ServiceAlly is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the three (3) months preceding the claim. The services are provided "as is."
14. Changes to these terms
We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date; continued use after changes means you accept them.
